After today's decision by the Constitutional Court, Ukrainian journalists might face a fine of (at least) 500 non-taxable minimum income or up to 5 years’ imprisonment for the publication of the facts of private life of Ukrainian politicians.
The decision of the Court renders almost all information about the politician and/or his family to be confidential.
Thus, under article 182 of the Criminal Code concerning privacy, illegal collection, storage, use or destruction or dissemination of confidential information about a person... shall be punished by a fine of 500 to 1000 untaxed minimum incomes or correctional labor for up to 2 years, or arrest for a period of 6 months or imprisonment for up to 3 years.
If the above steps were carried out repeatedly, the journalist can be imprisoned for up to 5 years.
At the same time, journalists have a chance to prove their innocence.
Thus, according to the law "On Information", section 29 provides that if the information is of high public importance and it outweighs the potential harm, the journalist can be found not guilty.
As reported by the "Comments", today, the Court has adopted a decision according to which the private life of politicians is now under a ban.
