"Stop Censorship!" requires explanations of the Security Service interrogation of blogger Shinkarenko

"Stop Censorship!" made an official statement on the Oleg Shinkarenko, blogger, being questioned by the Security Service of Ukraine who consequently forced him to write a receipt.

"Stop Censorship!" demands the Security Service of Ukraine explained what international laws and laws of Ukraine led SBU officers and prosecutors, when they called in for questioning blogger Oleg Shinkarenko. Also, activists ask to explain what is legal force of the receipt that writes "he will no longer criticize in rude form the establishment in his LJ blog”, and what sanctions will apply in case of default of its written promises.

In addition, activists are interested in exactly what “some signs of a crime” under Article "threat or violence against the state or public figure" of the Criminal Code of Ukraine are referred in the Statement of Security Service about the incident with Oleg Shynkarenko.

"Stop Censorship!" activists recall the leadership of the Security Service of Ukraine that the activities of the Security Service of Ukraine are clearly regulated by the Law of Ukraine "On Democratic Civilian Control over the Military organization and law enforcement" and is organized with the advice of the Parliamentary Assembly from 1999 and 2005 according to which Ukraine's duties and commitments arising from membership in the Council of Europe are performed.

Ukraine as a member of the United Nations and the Council of Europe adopted the values of these organizations and signed the Convention on Human Rights and Fundamental Freedoms, which states clearly that there can be no punishment without law. This is also clearly regulated by basic law of Ukraine:

Constitution of Ukraine, Article 19:

Legal order in Ukraine is based on the principles according to which no one can be forced to do what is not required by law.
State authorities and local governments and their officials are obliged to act on the basis, within the authority and in the manner envisaged by the Constitution and laws of Ukraine.


Convention on Human Rights and Fundamental Freedoms, Article 7:

No punishment without law. No man can be charged with a criminal offense under any act or omission which at the time they committed did not constitute a criminal offense under national laws or international law.

Article 10:

Freedom of Expression. Everyone has the right to freedom of Expression. This right includes freedom to hold opinions, receive and impart information and ideas without government interference and regardless of frontiers.

Movement "Stop Censorship!" asks to pay particular attention of all Security Service and other military organizations officers and law enforcement on the OSCE resolution "Freedom of expression of opinions on the Internet", supported by Ukraine as a member of the OSCE.
