Open letter – SOS!! Ukraine: beginning of the end of democracy and freedom of speech

Open letter of the Ukrainian journalists and society to the governments of the USA, countries of European Union, to international organizations, ungovernmental international associations and foreign MASS-MEDIA.
The Ukrainian media and civil community declare that democratic freedoms are convolving, human rights are violated and MASS-MEDIA is censoring. This is not isolated cases of pressure, but system work of the secret services and current government. We mean the forming of the new authoritarian mode, «soft dictatorship» with the «European» face.
As according to Russia's experience of twisting "nuts", the Security Service of Ukraine, Ministry of Internal Affairs and others use more subtle methods, providing direct and indirect influence on journalists and social activists. One of the most characteristic features of any dictatorship is controlling the information. The personnel policy of president talks about the desire of Victor Yanukovych to control media space in Ukraine. It is difficult to call an accident the appointment of media magnate, Valery Khoroshkovsky, as the head of Security Service (he takes 14th place among the richest people of Ukraine on information of the journal "Correspondent").
The examples of creeping authoritarianism in Ukraine are following situations in the country's information space:
1. The monopolization of media space in the hands of one of the oligarchs, the owner of Media Holding "Inter" and on combination the head of Security Service of Ukraine Valery Khoroshkovsky. Even today, Mr. Khoroshkovsky owns approximately 35% of the country's media assets. In opinion of Media experts, with his active participation were illegally taken away frequencies and licenses from such independent channels as "5-th channel” and “ТVі”.Such actions will force their closure. Those journalists or public organizations that oppose media monopolist Khoroshkovsky are under the pressure of security forces.
2. Tendentious reformatting of the National Council of Television and Radio, as well as pressure of the Security Service on the National Council, whose head has a private interest in the decisions of the National Council concerning the division of broadcast frequencies.
3. The disbandment of the National commission concerning the statement of a freedom of speech of the President of Ukraine. The commission, which consisted of the Ukrainian media experts, operated as an advisory body at the President, and was created to monitor the performance of the European and international media standards and facilitate the process of creation system of public broadcasting in Ukraine.
4. Establishment of the mode of censoring news. Journalists of national TV channels “1+1”and “STB” declared about interference of the authorities in editorial policy. On censoring of materials of the central TV channels appoints the monitoring of news by Internews Network “V-Media" and "Monitoring of compliance with journalistic standards and improving of media literacy of Ukrainian citizens", which “Telekritika” implements jointly with the Institute of Mass Information.
5. The systematic ignoring of information requests from the Ukrainian media (first of all by the Security Service, the Ministry of Internal Affairs, Cabinet of Ministers and the Presidential Administration) by public authorities.
6. On March, 23rd unknown persons have brutally beaten Vasil Demyaniv, chief editor of "Kolomiysky Vesnik”. The attack on Demyaniv is connected with his journalistic activity. Law Enforcement considers the attacks against journalists as "hooliganism", without seeing in these cases obstruction of professional activity of journalists.
7. After the visit of head of district state administration and the chairman of district council to a local regional newspaper "Vesnik Gorodischiny" in Gorodishe city (Cherkassy oblast), chief editor and all the journalists wrote an application for dismissal.
8. O April 30, 2010 in the city Slavuta, Khmelnitsky region was held a protest of journalists of communal newspaper “Truzhenik Polesie "against illegal dismissal of four employees. The Journalists demanded to stop the arbitrariness of the local council, which owns the newspaper.
9. On June 15, 2010 journalist of “STB” channel Sergei Andrushko was beaten by bodyguards of President Yanukovych. The authorities refused to investigate this fact.
10. In late June, office and journalists of “ТВі” were under surveillance by unknown persons.
11. Employees of Lviv newspaper "Express" declare about threats and pursuits by the regional prosecutor's office.
12. During April - June 2010 was preventive conversations of Security Service of Ukraine with journalist of “Kommersant-Ukraine” Artem Skoropadsky (was specified on possibility of deportation from Ukraine), with the rector of Ukrainian Catholic University Borys Gudziak, and representatives of “Demalyans”.
13. The women's movement FEMEN sent an open letter addressed to the head of the SSU Valery Khoroshkovsky with a requirement to stop the pressure and threats from the side of the special services on activists. On June 23, 2010, about 1AM the apartment of the leader FEMEN Anna Gutsol was infiltrated by people who presented themselves as law enforcement officers and brought her into the street using force. During two hours, according to words of A. Gutsol, she was hold in the car. These people required abolishing an action near the office of SSU, also they named the addresses of FEMEN activists.
14. The arrest of Vyacheslav Kononov, the coordinator of the public initiative "Freedom of speech!", during a picket of the meeting with U.S. Secretary, Hillary Clinton in the building of the Kiev Politehnichniy Institute on July 2, 2010. He was incriminated art.152 of the Code of Administrative Offences - a violation of city improvement. Also invitation of Kononov to the SSU and threat of legal actions about protection of honor and dignity of Khoroshkovsky. Activists of the initiative "Freedom of speech!" simply held in their hands signs saying "This country has censorship". Despite the fact that the action was legal (the organizers of the picket previously notified the city administration), police arrested Vyacheslav Kononov and took him to the Solomenska police department.

It is an incomplete list of the known facts that got public resonance, but there are other facts which journalists are afraid to declare, trying not to lose their jobs.
The repressions against public activists, prohibitive and limiting measures of the authorities against the freedom of peaceful meetings of citizens:
1. 30.06.2010 District Administrative Court of Kyiv in the person of Judge Marulina L.O. made a fateful decision for Ukraine about prohibition of holding the peaceful actions in the central part of Kiev.
2. At the initiative of the Cabinet of Ministers, in June was introduced a bill number 2450 about freedom of peaceful assembly, which is adopted by the Verkhovna Rada in the first reading June 3, 2009. The document requires citizens to notify local authorities about the meetings five days before the actions. Representatives of several NGOs opposed this bill, believing that in case of adoption the authorities will have a ground to forbid peaceful meetings.
3. The Governor of Kharkov Mikhail Dobkin has issued an order number 302, by which he decided to liquidate the "unruly" Regional Student Council. The cause of liquidation was an open letter of students who protested against the felling of trees in the Gorky park.
4. Denis Chernega and Andrey Evarnitsky (environmental activists) were arrested because of protesting against cutting down of trees in the Gor'kov Park in Kharkov. They were condemned for their right of freedom of speech and freedom of assembly. Amnesty International considered them as prisoners of conscience.

Many Ukrainian journalists and public figures have already declared their position against the cpnvolving of the civil democratic transformations in Ukraine.
A social movement "Stop Censorship" was created in June, which gathered about 600 signatures of journalists. It includes such well-known journalists in the country as Mustafa Naem (Internet edition “Ukrinskaya Pravda "), Julia Mostovaya (weekly" Zerkalo Nedeli "), Roman Chayka (5 Channel), Nicholay Kniazhitsky (TV channel “TVI"), Jean Novoseltsev (TV channel "1+1") leading media experts Natalia Ligacheva (Journal “Telekritika”), Victoria Syumar, Taras Shevchenko, and many others.
Journalists and public figures personally handed an open letter to President Yanukovych, asking him to pay attention on facts of censoring. However, the President instructed the head of the Security Service of Ukraine Valery Khoroshkovsky to investigate the facts. It is not clear why Viktor Yanukovych instructed to resolve problems associated with the censors to the head of the SSU, who is suspected by journalists in organizing the pressure on independent media. We are aware that the President of the Security Service has clear plenary powers, and, consequently, he has no right to deal with all the information issues in the state.
In the democratic state, as it named also by the present power, system censorship should be impossible, and an information space opened, transparent and civilized. After meeting with representatives of the movement "Stop Censorship" Hillary Clinton also declared that the U.S. wants to cooperate with Ukraine in the questions of “distribution of democracy and supremacy of law." She said that new government has proved that adheres to the principles of democracy.
However, we note that the Ukrainian government, represented by the main security officials Khoroshkovsky and Mogilev, systematically violate the principle of independence of the media, conduct targeted attacks on freedom of assembly, association and freedom of speech.
We ask the international community to not believe every word of Ukrainian authorities, and conduct a thorough independent investigation of the facts of censorship, beatings of journalists, the unauthorized dismissals, restrictions on democratic rights.
